• A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law
• A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed

3. How to Submit a DMCA Takedown Notice

To submit a DMCA takedown notice, please send your notification to our designated Copyright Agent:

Please note that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing may be subject to liability for damages.

4. Counter-Notification

If you believe that your material that was removed (or to which access was disabled) is not infringing, or that you have the authorization from the copyright owner, the copyright owner's agent, or pursuant to the law, to post and use the material, you may send a counter-notification containing the following information to our Copyright Agent:

4.1 Required Information for Counter-Notification

• Your physical or electronic signature
• Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or disabled
• A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or a misidentification of the material
• Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal court in your district, or if your address is outside of the United States, for any judicial district in which 3 Patti Gold may be found, and that you will accept service of process from the person who provided notification of the alleged infringement

If a counter-notification is received by our Copyright Agent, we may send a copy of the counter-notification to the original complaining party informing that person that we may replace the removed material or cease disabling it in 10 business days. Unless the copyright owner files an action seeking a court order against the content provider, member, or user, the removed material may be replaced, or access to it restored, in 10 to 14 business days or more after receipt of the counter-notification, at our sole discretion.

5. Repeat Infringers

It is our policy to terminate, in appropriate circumstances, the accounts of users who are repeat copyright infringers. A repeat infringer is a user who has been notified of infringing activity more than twice and/or has had infringing material removed from our service more than twice.

6. Procedure for Filing a DMCA Notice

1. Gather all required information as listed in Section 2.1
2. Compose your DMCA notice email with all required information
3. Send the email to dmca@3patti-gold.net with the subject "DMCA Takedown Notice"
4. Wait for our response (typically within 48 hours)
5. We will review your notice and take appropriate action if valid

7. False Claims

Please be aware that if you knowingly materially misrepresent that material or activity on 3 Patti Gold is infringing your copyright, you may be held liable for damages (including costs and attorneys' fees) under Section 512(f) of the DMCA.

8. Our Response to DMCA Notices

Upon receipt of a valid DMCA notice, we will:

• Review the notice for completeness and validity
• Remove or disable access to the allegedly infringing material
• Notify the user who posted the material about the takedown
• Provide the user with information about filing a counter-notification if they believe the notice is incorrect
• Respond to the copyright owner within 48 hours
